The first ten amendments to the United States Constitution are also called The Bill of Rights; other than the Preamble, they’re probably the most well known and referred to section of the U.S. Constitution. These ten amendments lay out specific rights and protections that individuals have from the federal government. Many of the delegates to the Constitutional Convention of 1787 were concerned about protecting individual freedoms from the concentrated power and intrusion of a federal government and actually refused to sign the Constitution unless a statement of rights was included in the work. Twelve amendments were sent to the states based in part on the Virginia Declaration of Rights. Only ten were ratified and went into effect on December 15, 1791.

The First Amendment covers a lot of ground and is a really great start to protecting our individual liberties.  It deals with religion, personal expression, assembling with other like minded individuals, and disagreeing with government without fear of retaliation. Our forefathers knew a time when the government controlled the church and used religion to imprison or execute others that differed in opinion. They knew that to truly be free you should be able to worship as you see fit. So the First Amendment protects a person’s right to worship or not and the state will not endorse a single church. In other words, there will not be a Church of the United States like there was a Church of England. There is also protection for speech or expression in things like the press. The modern day equivalent would be the internet. This was specifically put there to protect political speech so that the government could not squash those who dissent. The First Amendment says that congress has no right to stop us from disagreeing vocally or in print. They will not stop us from organizing our political efforts as long as they’re peaceful. We have the right to complain about our government without fear of imprisonment or execution.

The Second Amendment is wildly controversial. Sometimes I wonder why since it simply says that Congress will not try to stop us from protecting ourselves. We have the right to own firearms to protect ourselves from foreign invaders, the criminal element, and from an out of control federal government. The American Revolution would have ended dramatically different if the rebels (our guys) would not have had weapons with which to fight the British. As long as the American population is armed, there will always be a check for an out of control tyrannical government.

The Third Amendment seems a little dated and is kind of hard to relate to today. It says that Congress will not make a home owner keep a soldier in their home in a time of peace.  In a time of war, Congress can only ask it in a manner prescribed by the law. I don’t think there are many situations where this one will come into play today, but when referring to government abuse, anything's possible..

The Fourth Amendment says you have the right to be secure in your person and property from unreasonable searches or seizures. There has to be a probable cause for a warrant to search and it has to specific about what and where is searched. It also has to be specific about what is to be seized. In other words, the government can not just run over your privacy without just cause.

The Fifth Amendment talks about the right to trial by a Grand jury for capital crimes, not being subject to double jeopardy for the same crime, not testifying against your self, the right to a due process, and property rights. If you are accused of a capital or “infamous” crime, you have the right to a jury of 12-23 people to determine if there is enough evidence to go to a trial. You can not be tried for the same crime twice in the United States. You have the right to remain silent and not give evidence against yourself. You have the right to a “due process” or regular administration of the law where everyone is subject to the same principles. You are to be justly compensated if the government needs your property for public use.

The Sixth Amendment guarantees your right to a quick and public trial if accused of a crime. You shall have an unbiased jury and a trial in the area where the crime was committed. You have the right to confront your accusers and be represented by an attorney whether you can afford it or not.

The Seventh Amendment states that a trial by jury is guaranteed even for cases other than criminal as long as the matter in question exceeds twenty dollars. Several of the amendments deal specifically with criminal trials. This amendment takes a different direction and touches on civil cases.

The Eight Amendment offers protection against excessive bails and fines. It also shields us from cruel and unusual punishments. When we read these amendments that seem so obvious, we have to remember the history involved with the authors. Their government at the time, Great Britain, utilized the court system against the colonists. When the government’s case was weak, they would simply charge excessive monies or delay the trial (hence the Sixth Amendment) or stack the jury (Fifth Amendment protection).

The Ninth Amendment says that just because we the people are listing are rights here in this “Bill of Rights”, we are not surrendering any other rights we may have inherently. We are not cancelling or giving away any of our rights, we still retain them; always.

The Tenth Amendment is the icing on the cake. It says that any power not listed for the federal government is retained by the states and ultimately the people. In other words, if we didn’t give the federal government specific and explicit directions then they have none. Their power comes from the consent of the governed only. No more and no less. We the people always trump the government.

I love and cherish the Bill of Rights and believe all the protections of liberty are so very vital to our Republic, that it is hard to select just one to talk about. There is one that stands out in my mind as a linchpin for the whole structure and that’s the Second Amendment. All you have to do is examine world history to see what happens when there is no force to stop tyrannical government; political and religious persecutions, imprisonments, and exterminations. The list is too long; the Soviet Union in 1929, China in 1935, Germany in 1938, Uganda in 1970 and on and on it goes. If the general population had been able to remain armed then these events might have unfolded differently. Even Mahatma Ghandi said, "Among the many misdeeds of the British rule in India, history will look upon the act of depriving a whole nation of arms, as the blackest." Make no mistake; it takes force to stop tyranny. If an unresponsive statist government cannot be changed within the system and at the ballet box, and they ever figure out a way to disarm the American people, then this great Republic is just marking time. The Second Amendment is the ultimate check and balance on the federal government and our framers, like Thomas Jefferson, knew this when he said, “The strongest reason for the people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government.”

Content is KING. Whether you’re talking television, radio, internet or print, those who can create compelling content, gather an audience and keep them can virtually write their own paychecks.   The talent will eventually migrate to the highest reward for their time. That is assuming of course that we seek to maintain a free market where they are allowed to act in their own best interest without some crazed government intervention like the Fairness Doctrine.

Viewers, listeners and readers will pursue the content that they want. I enjoy listening to the Mark Levin show. The AM radio station he comes on in my market does not have very good reception and the time slot is also not convenient. Most of the time, I download his broadcasts from the internet to my MP3 player or listen to streaming radio. The internet is also the major source for my music listening when I’m working, studying or just playing Texas Hold’em.

Multiple streams of content should be the future we envision and pursue. Let the talent seek to maximize their earnings and let the people seek the content they desire. If you want Howard Stern you’ll have to go satellite radio. On the other hand, Rush Limbaugh has chosen to stay with broadcast radio because he can’t generate the same advertising revenue through satellite radio. Now, if you want Oprah you’ll have to turn to cable.   When we keep the market free from interference we provide the most opportunities for the producers and consumers of content.   This is the way to prosperity. This is the way to freedom.
